Case Summary:
The Plaintiff's part contains an Aarakocra with 25AC and the Mobile feat. This makes the PC very difficult to hit. The Aarakocra was banished during a fight with pirates and the remaining party was womped; including Alexander V., who "died alone, below deck". The remaining pirates gathered around the location the Aarakocra was banished from and waited for them to return where they would proceed to womp the remaining PC. The Aarakocra argued that they should re-appear above the water, well behind the ship because the ship was moving during their banishment.
Verdict:
RAW: "The target reappears in the space it left or in the nearest unoccupied space if that space is occupied". The bench agrees that the DM forgot that ship was moving (and likely used this movement to their own benefit). However, Justice Hurwitz dissents under the premise that the definition of "space" should indicate the colloquial location rather than the physical dimensional space. In response, Justice Murph invokes The Nightcrawler Defense which supports the definition of physical dimension.
